The government decided to make vigilantism "legal" by making heroics legal, under laws, which created Heroes, while the criminals became Villains. It was a gradual change with lots of power shifts.
Scott's world is heading into that vigilante era.
[Where unsanctioned heroes use their mutant powers to fight criminals who use their mutant powers selfishly. Which causes friction with the government and the public. And makes a scramble ground for emerging villains. A messy era...]
